Bit House Digital provides marketing services tailored to businesses in various industries, including but not limited to, contractors in the construction industry, as outlined in an accompanying service order ("Order Form"). Our specialized services include, but are not limited to, online advertising, lead generation, estimate generation, and targeted digital marketing campaigns for businesses. Any additional services requested will require a separate written agreement.
You agree to pay the fees stated in your Order Form. Payments are due in U.S. dollars and will be charged via credit card, ACH, or other approved methods.
Fees are billed on a monthly recurring basis unless otherwise agreed. Failure to make timely payments may result in suspension or termination of services. If your primary payment method fails, you must update payment details within 5 business days of notice from Bit House Digital.
Unless otherwise agreed, this Agreement will automatically renew on a monthly basis until terminated by either party with 10 days' written notice. Any changes to the fee schedule will be communicated to the client with a minimum of 30 days' notice.
The term begins on the Effective Date and continues as specified in the Order Form. Services continue on a month-to-month basis unless terminated by either party.
You may cancel your services by providing 30 days' written notice before the next billing date via email to support@bithousedigital.com.
Bit House Digital may suspend services due to:
If services remain paused for 30 consecutive days, you will be charged a $149 monthly fee to maintain account access and platform configurations. This fee is subject to change at any time.

The guarantee is voided if any of the following occur during the 30-day term:
Bit House Digital provides all services on "an 'as is' and 'as available' basis without warranties of any kind." The company makes no guarantee regarding specific results, uninterrupted service, or error-free performance.
Bit House Digital cannot be held responsible for indirect, incidental, special, or consequential damages, including lost profits or data. Liability is capped at fees paid during the preceding 12 months.
Before filing a formal claim, both parties agree to attempt to resolve any dispute in good faith through direct communication.
Any unresolved disputes shall be settled through binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration shall take place in CA and be conducted in English. By agreeing to arbitration, both parties waive any right to a trial by jury or to participate in a class action.
Both parties agree to maintain the confidentiality of all non-public information exchanged during the engagement.
You agree to make every reasonable effort to resolve any payment disputes directly with Bit House Digital before initiating a chargeback. If a chargeback occurs, the Client agrees to reimburse Bit House Digital for any costs or fees incurred as a result of the chargeback, including any legal or administrative fees required to resolve the dispute.
Bit House Digital LLC may use third-party landing page builders or CRM platforms to create and manage client pages and systems.
If the Client cancels their services but wishes to continue using the landing pages or CRM system set up by Bit House Digital LLC, continued access will be granted for a monthly fee of $199.
This fee covers platform access and hosting of the existing system only. It does not include ongoing updates, edits, or support. Any requested edits, updates, or modifications will be quoted separately and require written approval before work begins.
Failure to pay this fee will result in immediate suspension and removal of access to the platform and all associated assets.
Bit House Digital LLC reserves the right to modify this fee with 30 days' written notice.
Unless otherwise agreed in writing, any photos, videos, ad creatives, scripts, or other marketing content created by Bit House Digital LLC remain the sole property of Bit House Digital LLC.
If the client has paid a separate, clearly itemized fee for content creation and we have explicitly agreed in writing that the content is being created as a "work for hire," ownership may be transferred to the client.
In all other cases, clients are granted a non-exclusive, non-transferable license to use the content solely for their own business purposes during the term of our engagement. This license does not include the right to resell, modify, or repurpose the content outside the original campaign scope. All usage rights are subject to the terms outlined in this agreement.
Bit House Digital LLC retains the right to use, modify, or repurpose any content we create, including video ads, images, scripts, and other materials, for marketing, portfolio, internal training, or promotional purposes, unless the client has requested in writing that specific assets remain private.
The client retains full ownership of any content they provide to Bit House Digital LLC, including but not limited to images, videos, logos, brand assets, testimonials, or other materials ("Client Content").
By providing such content, the client grants Bit House Digital LLC a non-exclusive, royalty-free license to use, edit, and incorporate the Client Content into advertising campaigns or marketing materials as needed to fulfill the services under this agreement.
The client represents and warrants that they have the legal right to use and share all Client Content and that such use will not infringe upon any third-party rights. Bit House Digital LLC will not be held liable for any copyright or trademark violations related to Client Content provided by the client.
When client-supplied content is incorporated into ads or creative assets developed by Bit House Digital LLC, the client retains ownership of their original materials. However, the final edited ad, including all scripting, structure, voiceovers, editing, effects, and other enhancements, remains the intellectual property of Bit House Digital LLC. The client is granted a non-exclusive license to use the completed asset for their own business purposes, but may not modify, resell, or reuse the creative outside the original campaign scope without prior written permission.
Bit House Digital LLC values your feedback. Testimonials, reviews, and other submitted content may be featured, along with the submitter's name and location, across various activities related to Bit House Digital LLC services. These may be used in both print and online media at our discretion. Note that individual experiences may vary, and testimonials may not reflect your own.
By submitting testimonials, photos, or information, you grant Bit House Digital LLC a non-exclusive license to use them. We reserve the right to correct errors, shorten testimonials, and review all submissions.
You may contribute legal, non-threatening content, and we may edit or remove it at our discretion. By posting or sending testimonials, you grant Bit House Digital LLC the right to use, reproduce, and distribute them globally. We retain the right to monitor and edit or remove any content but are not responsible for posted content.
Please note that "all phone and video calls, including those made through platforms like Google Meet and Zoom, may be recorded." By communicating with Bit House Digital LLC through these channels, you consent to these recordings being used for training purposes and potentially for testimonial videos, unless you specifically request that the recording not be used during the call. California is a two-party consent state. By continuing communication with Bit House Digital LLC, you acknowledge that you are aware of the recording and consent to its use, unless you explicitly opt out during the call.
This Agreement is governed by the laws of California.
If any provision is deemed unenforceable, the remaining terms remain in effect.
Bit House Digital reserves the right to update this Agreement with prior notice.
By engaging our services, you acknowledge that you have read, understood, and agreed to the terms of this Agreement.
